1. Business organization of overseas study consulting services
Organizations providing study abroad consulting services include:
– Enterprises established and operating in accordance with the Law on Enterprises;
– Non-business units with this service business function;
– Foreign educational institutions operating legally in Vietnam.
These organizations provide study abroad consulting services in the following forms:
– Introduce, consult information on education policies of countries and territories;
– Advice on choosing schools, courses, professions and qualifications suitable to learners’ abilities and aspirations;
– Organizing advertising, conferences, seminars, fairs and exhibitions about studying abroad;
– Recruiting students, recruiting students to study abroad;
– Fostering necessary skills for Vietnamese citizens to study abroad;
– Sending Vietnamese citizens abroad to study; Take parents, guardians to visit the training place abroad;
– Other activities related to this service business.

2. Regulations on conditions for organizations
– Business organizations established in accordance with law;
– Having a head office, facilities and equipment to serve the study abroad consulting business;
– The staff directly consulting has university degrees or higher; Able to use at least one foreign language at level 4 or higher according to Vietnam’s 6-level framework and equivalent;
– The staff directly consulting must have a certificate of professional training in overseas study counseling.
3. Rights and responsibilities of overseas study consulting service business organizations
3.1 Rights of business organizations
– Sign enrollment representative contracts with foreign educational institutions;
– Publicize organizational information on the website of the agency that issues the Certificate of overseas study counseling service business;
– Exercising the rights of enterprises without violating their responsibilities;
– Receive remuneration according to the consulting contract agreement.
3.2 Responsibilities of the business organization
– Register for the Certificate of Business Registration for overseas study consulting services;
– Implement the consultancy within 45 working days from the date of issuance of the Certificate;
– Provide honest and accurate advice on conditions related to the accreditation status of educational programs and foreign educational institutions. Accurate about tuition fees, expected living expenses and related fees; on living conditions, overtime policy according to the regulations of the host country; the risks and uncertainties that may be encountered during the study abroad process;
– Sign a contract with a person wishing to study abroad or sign a legal guardian’s parent’s agreement on the principle of voluntary agreement;
– Failing to authorize or receive authorization from another organization to conduct business in overseas study consulting services;
– To publicly post information at the head office and on the electronic information page of the business organization. To take responsibility before law for the accuracy of the declared information and contents;
– Maintain contact, coordinate with foreign educational institutions, monitor and support international students during their study abroad period. Urging international students to update information into the database system. Actively coordinate with agencies to protect the legitimate rights and interests of international students.
– Maintain records to send Vietnamese citizens abroad to study;
– Continue to keep in contact with international students after graduation;
– Provide evaluation information on the effectiveness of the consultation when requested by the State agency.
