Question:
Our company has been operating for 5 years in the field of chemical trading for strictly commercial purposes. We have not engaged in any production activities. Now, we have a need to expand and incorporate the production of fabric softener and candle making into our business. How should we proceed?
Answer:
– According to Official Letter 6230/UBND-KT dated November 2, 2016, issued by the People’s Committee of the city regarding the registration of business activities in accordance with the development plan for industries and sectors within the city, and based on Official Letter 201/SCT-KTATMT dated January 6, 2017, issued by the Department of Industry and Trade on the registration of business activities in the field of chemicals and fertilizers, for the industry of “Chemical Production,” if the enterprise does not operate within industrial zones, it is required to commit not to engage in this sector (at its registered office).
– The enterprise may refer to the registration of sectors according to Decision 27/2018/QĐ-TTg dated July 6, 2018. This decision was issued by the Prime Minister and pertains to the Vietnam Economic Sector System. Specifically, these sectors include 3290 Other Manufacturing Not Elsewhere Classified. They encompass the production of fabric softeners and candles (without producing chemicals at the registered office).
