Legal framework for the emerging real estate model: FARMSTAY?

1. Trends change, real estate model “farm tourism” is on the throne

Recently, the trend of tourism has had a breakthrough, today, famous tourist destinations such as Da Nang, Hanoi, etc. no longer attract tourists as much as before. Instead, places that are still wild and close to nature become “hot” destinations for travelers who love to explore.

Over the past two years, the price of land in Lao Cai has continuously increased when it has become the location to build many Farmstays – a model combining agricultural production and tourism… And real estate exploitation has been mentioned a lot recently. Many investors design Farmstay with an overnight stay model, costing billions of dong.

With the tendency to be closer to nature, Farmstay has become the preferred type of resort tourism. Usually, a Farmstay model is developed with many service packages such as:

– Dining area, combined with entertainment;

– Experience travel, explore nature, ethnic communities, …

However, this is a completely new real estate model Farmstay has not yet had a legal mechanism to regulate. So this seemingly promising model is operating illegally.

2. The legal corridor for Farmstay needs to be researched and developed soon

The biggest obstacle in developing this model in Vietnam is that the legal basis is still incomplete. Tan Loi Cooperative shared that the business is looking to develop tourism in combination with farming and gathering, etc. Towards a model of agricultural education experience for students. At the same time, doing eco-tourism for visitors to experience clean agricultural products. But the plan cannot be developed according to the Farmstay model, which brings higher economic efficiency due to legal problems.

Specifically, the problem is that the current Land Law only regulates general content such as:

– Principles, grounds and contents of the planning;

– Land use plan, authority to make, approve and adjust;

– Collecting people’s opinions on land use master plans and plans;

– Implementation of master plans and land plans.

There are no specific regulations on planning and use of “agricultural tourism land.”

With the strong “budding” of Farmstay, there are signs that this will be a development model if exploited and invested seriously. Therefore, the legal mechanism should soon identify “agricultural tourism land” to seize the “opportunity” of the development of the Farmstay model.
