The new draft of the Land Law has added provisions on general principles for compensation and resettlement support when the State recovers land.
1. Specify general principles on compensation and resettlement support
The latest draft of the Land Law has removed the principle of “Ensure people whose land has been recovered have a place to live, guaranteed income and living conditions equal to or better than the old place of residence”. Instead, this principle will be concretized by specific regulations. The draft law adds many forms of compensation when land recovery such as:
– Compensation in cash;
– Compensation in land or housing.
Specifically, the Draft stipulates land compensation by allocating land for the same use purpose. If there is no land to compensate, people will be compensated in money. In addition, families and individuals whose land is recovered will be considered for compensation with land for purposes other than the type of land recovered or housing… This case will be considered only if the family, Individuals have needs and localities have conditions for housing and land funds.
The new regulations on the time limit for paying compensation and resettlement support are very favorable for people. The draft law stipulates that within 30 days from the effective date of the land recovery decision, compensation and support must be paid. In case of late payment, the person whose land is recovered will be paid an additional late payment amount.
2. Create better living conditions for people whose land is recovered

The draft law has added the principle that resettlement areas must complete technical and social infrastructure conditions according to the approved detailed planning. At the same time, it must be consistent with the traditions, culture, etc. of the community whose land is recovered. In addition, the draft also stipulates that people whose residential land is recovered to implement commercial housing projects will be resettled on the spot. If while waiting for resettlement arrangements, people have no other place to live, they will be placed in temporary housing or receive housing rental support.
