1. Condotel is granted a certificate of ownership
Decree No. 10/2023/ND-CP amending and supplementing a number of articles of decrees guiding the implementation of the Land Law takes effect from May 20, 2023. The new regulations officially issue pink books for construction works intended for tourist accommodation (Condotel), which makes the opportunity to “revive” this segment more obvious.
The certification of condotel ownership shall comply with the provisions of Decree 10. The presentation of information about the land plot on the Certificate must be in accordance with the purpose and duration of land use as prescribed.
2. Conditions for participating in the auction of land use rights
Organizations participating in auctions must meet the following conditions:
– Belongs to the State allocated or leased land. In case of auction of a plot of land or a project consisting of one or more plots of land with 02 or more companies cross-owning each other… Only 01 company will participate in the auction of land use rights above;
– Satisfy the conditions in Clause 3, Article 58 of the Land Law; Clauses 2, 3, Article 14, Decree 10/2023/ND-CP;
– Cash payment in advance of 20% of the total land value according to the starting price;
– The law must not ban them from participating in auctions.
– Satisfy the legal requirements on housing and real estate business.
Households and individuals participating in the auction of land use rights must satisfy the following conditions:
– Being subject to land allocation or land lease by the State;
– Cash payment in advance of 20% of the total land value according to the starting price;
– Not being banned from participating in auctions in accordance with the law;
– Satisfy the conditions in Clause 3, Article 58 of the Land Law; Clauses 2, 3, Article 14, Decree 10/2023/ND-CP;
– Satisfy the legal requirements on housing and real estate business.
3. Conditions for land put up for auction of land use rights
– Satisfy Clause 1, Article 119, Land Law;
– The authorities have decided the starting price for the auction conducted for each land plot.
– Having detailed planning 1/500 and approved for the implementation of investment projects on housing construction.
