The process of online registration for a business license

The benefit of online business registration is that you can actively arrange the time to submit the application, saving time and costs. HMLF will guide how to apply for an online business license for Households.

Note, Business households do not have legal status:

– Business households do not have their own seals;

– Not allowed to open branches or representative offices.

1. Online business license registration form for household business

According to Circular 02/2023/TT-BKHDT, you can register for a business license in the following two ways:

First, business registration by digital signature:

– Digital signature has the same legal value as the seal of the organization;

– Business households must submit electronic documents instead of paper submissions.

Second, register your business by authorizing someone else.

2. Application for registration of online business license Household business

According to Circular 02/2023/TT-BKHDT, the online registration application includes the documents in Decree 01/2021/ND-CP presented in the form of electronic documents:

– Application for business household registration;

– Legal documents of the owner of the Business Household. In case Household members register as Business Household, submit legal documents of household members;

– Copy of the meeting minutes of Household members on the establishment of Household Business (In case Household members register Business Household);

– Copy of the Household member’s authorization document for 01 member who is the head of the household (In case Household members register as Business Household).

In case of authorizing another person to carry out business registration procedures, the Business Household owner needs to supplement some necessary documents. There are 04 cases authorized by the business household owner as follows:

– In case of authorization for an individual, additional documents include:

– Power of attorney (notarization is not required);

– Copy of legal papers of authorized individuals.

– In case of authorization to an organization, additional documents include:

– A copy of the service contract for carrying out procedures related to business registration;

– A letter of introduction from that organization for the individual who directly carries out business registration procedures;

– Copies of legal documents of the referred individual.

In case of authorization to a public-utility postal service provider, additional documents include:

– A copy of the application form to the service provider. The application must have the signature of the postal employee and the person authorized to sign the business registration application.

In case of authorizing a postal service provider other than a public utility post, additional documents include:

– A copy of the service contract for carrying out procedures related to business registration;

– A letter of introduction from that organization for the individual who directly carries out business registration procedures;

– Copies of legal documents of the referred individual.

3. Steps to register business household online

Step 1: Log in to your account on the National Business Registration Portal. Login link: https://dichvuthongtin.dkkd.gov.vn/inf/default.aspx

Step 2: Declare information and download electronic documents, sign and authenticate documents and pay fees.

Note: Household business registration fee is non-refundable in case business household registration is not granted

Step 3: Within 03 working days from the date of receipt of the complete application, the business registration office of the district/district will return the receipt of the application and the result of handling the business household registration procedure to the applicant.

Step 4: Receive settlement results.

Currently, Business Households do not have to submit paper documents and can receive Business Household Registration Certificates directly at the business registration office at the district/district level where the business is located. Or Household businesses can register and pay fees to receive them by post.
