The regulations regarding the provision of company information

In the modern business landscape, transparency and accessibility of company information play a crucial role, not just for regulatory compliance but also for fostering trust among stakeholders. Moreover, the regulations that govern the provision of company information serve as a fundamental framework to ensure that businesses operate with accountability and transparency. In this discussion, we will explore these regulations comprehensively, emphasizing the requirements, procedures, and the profound significance of furnishing precise and current company information.

Question:

Firstly, I would like to request specific business information, including the details of each change and certified copies of the business registration certificates for these changes. Moreover, I need confirmation from the Department, and I’m curious about the procedures I should follow to obtain this information.

Answer:

In accordance with Article 32, Clause 1 of Law on Enterprises 2020:

1. After an enterprise is granted the Certificate of Enterprise Registration, it shall announce it on the National Enterprise Registration Portal and pay the fee as prescribed by law. The announcement shall include the content of the Certificate of Enterprise Registration and:

a) The enterprise’s business lines;

b) The list of founding shareholders and foreign shareholders (for joint stock companies).

As outlined by Article 33, Clause 2 of the Law on Enterprises 2020:

2. Business registration authorities shall fully and promptly provide information in accordance with Clause 1 of this Article.

Consequently, the Business Registration Office is solely authorized to offer information in line with the previously delineated regulations.

So in cases involving enterprises, it is advisable to send official communication via conventional mail to the Business Registration Office – Department of Planning and Investment of Ho Chi Minh City. Moreover, if the submitting party is not the legal representative, it is recommended to include a Letter of Introduction in the application to facilitate the process.

Conclusion

In conclusion, the regulations pertaining to the provision of company information play a pivotal role in fostering transparency and trust within the corporate world. Compliance with these regulations is not only a legal obligation but also a strategic move that can enhance a company’s reputation and facilitate smoother interactions with partners, investors, and regulatory authorities. Finally, as businesses continue to navigate a complex and interconnected global market, adhering to these regulations remains a fundamental aspect of responsible corporate governance.
