Currently my company is planning to invest abroad. But I do not know the forms that the law allows to invest abroad. Therefore, ask a lawyer to help answer the forms of investment abroad.
According to the provisions of Article 52 of the Law on Investment in 2020, investors conduct offshore investment activities in the following forms:
– Establish an economic organization according to the laws of the investment receiving country;
For example, if you want to set up a business in Cayman, the regulations on establishment conditions as well as the paperwork to establish you will have to comply with the laws of Cayman.
– Implement BCC contracts abroad;
BCC is a type of business cooperation contract. The company you signed with an investor in Singapore wants to do business together in Singapore to share profits and distribute products.
– Acquiring part or all of the charter capital of an overseas economic organization to participate in the management and conduct of business investment activities abroad;
In this form, you will not have to establish a new economic organization, but in order to have a certain right to do business in a foreign country, if you buy part or all of the charter capital, you will also enjoy the profit earned in proportion to the investment in that Enterprise.
– Buy and sell securities and other valuable papers or invest through securities investment funds or other intermediary financial institutions in foreign countries.
