Question:
I would like to inquire about the registration of the industry: 7830: Labor supply and management. Details: Sending Vietnamese workers to work temporarily abroad. What conditions are required by the Department of Planning and Investment for me to register in this industry? And after obtaining the license from the Department, do I need to register anything else for my business?
Answer:
Based on Article 8 of the Law on Vietnamese Workers Working Abroad under Contract:
1. The activity of providing services to send workers to work abroad is a conditional business sector.
2. Enterprises engaged in the provision of services to send workers to work abroad (hereinafter referred to as service enterprises) must have the prescribed capital under the regulations of the Government and obtain a License for the provision of services to send workers to work abroad from the competent state authority.”
– Based on Article 6 of Decree No. 38/2020/ND-CP guiding the Law on Vietnamese Workers Working Abroad under Contract, this is a profession that requires a prescribed capital of 5 billion VND and has owners, all members, and shareholders as domestic investors under the regulations of the Investment Law.
– The documents, procedures, and sequence for changing business sectors shall be carried out according to the regulations in Article 48 of the Enterprise Law 2020. After completing the documents for changing the business sector, the enterprise should contact the Department of Labor, Invalids, and Social Affairs to carry out the procedures for obtaining a license.
