According to the regulations, representative offices of foreign traders in Vietnam are not to directly recruit Vietnamese employees to work for them. Instead, they must go through an authorized organization to recruit and manage Vietnamese workers for foreign individuals or organizations.
Therefore, the selection, introduction or management of Vietnamese workers working at representative offices will under the jurisdiction of the organization by the Ministry of Foreign Affairs or be authorized. For example, in Ho Chi Minh City, the currently authorized organization is FOSCO – a limited liability company providing State agency services.
Regarding the recruitment service fees, there are no specific regulations in the legal service. In practice, the service fee for the selection and introduction of Vietnamese employees in the representative office at FOSCO currently ranges from 20% to 30% of the first-month salary of the recruited worker. Please note that this fee may be subject to change by FOSCO at different times.
