1. Entities Subject to Value Added Tax (VAT)
Entities subject to VAT include goods and services used for production, business, and consumption in Vietnam. This includes goods and services purchased by foreign organizations and individuals in Vietnam, except for entities exempt from VAT.
2. Goods Exempt from Value Added Tax
- Agricultural and aquaculture products that have not been processed into finished products or have only undergone basic processing by organizations or individuals for self-production and sale upon importation.
- Breeding animals and plants at the cultivation stage, imported and commercially traded, such as:
– Breeding eggs, animal breeds, plant breeds, seeds, seedlings, cuttings.
– Semen, embryos, genetic materials.
- Salt produced from seawater, natural rock salt, refined salt, and iodized salt primarily composed of NaCl.
- Residential houses sold by the State to tenants.
- Goods specified in Section 17, Article 4, Circular 219/2013/TT-BTC, which are not produced domestically.
- Specialized weapons and military equipment used for defense and security purposes.
- Imported goods, products, and services provided for humanitarian and non-refundable assistance.
- Goods in transit, temporarily imported, re-exported, or temporarily exported and re-imported.
- Imported raw materials and supplies for production and processing under contracts signed with foreign entities.
- Imported gold in bar or piece form and unprocessed gold of any type.
- Natural resources and minerals extracted for export, not yet processed into finished products.
- Artificial products used as substitutes for body parts of patients, disabled individuals, and prosthetic devices.
- Goods and services provided by households or individuals engaged in business with an annual income of less than VND 100 million.
- Tax-exempt goods held in national reserves and sold by the national reserve agency.
3. Services Exempt from Value Added Tax (VAT)
- Services related to agricultural production such as irrigation, watering, plowing, and dredging of canals and internal waterways.
- Land use rights transfer services.
- Various insurance services, including
– Life, health, student, and other insurance related to individuals.
– Insurance for livestock, crops, and other agricultural insurance.
– Insurance for vessels, boats, equipment, and other necessities for direct fisheries.
– Reinsurance.
- Financial, banking, and securities services, as specifically regulated in Section 8, Article 4, Circular 219/2013/TT-BTC.
- Medical and veterinary services.
- Maintenance of zoos, botanical gardens, parks, street greenery, public lighting services, and funeral services.
- Maintenance, repair, and construction services funded by:
– People’s contributions.
– Humanitarian assistance for cultural, artistic projects, public service facilities, infrastructure, and housing for social policy beneficiaries.
- Education and vocational training.
- Broadcasting via radio and television using state budget funds.
- Publishing, importing, and distributing newspapers, magazines, and products specified in Section 15, Article 4, Circular 219/2013/TT-BTC.
- Public transportation services.
- Technology transfer.
