Does company need to ask for import license requirement for Siemens HiPath 3800 Digital Telephone Exchange?

Our company imports the Siemens HiPath 3800 digital telephone exchange, hs code: 85176230. However, during the import procedures, we encountered Decree No. 58/2016/ND-CP, which lists Civil Cryptographic Products that require an import license. We contacted the Civil Cryptographic Product Management and Product Inspection Department, and they confirmed that our Telephone Exchange is not considered a Civil Cryptographic Product. Now, we are reaching out to the Ho Chi Minh City Customs Department to inquire if our product requires an import license.

Answer:

Based on Decree No. 58/2016/ND-CP dated July 1, 2016, issued by the Government, it is stipulated in Article 1 that Civil Cryptographic Products for import and export, as listed in the Appendix II of this decree, require a license for import and export, regardless of whether the purpose is for commercial or non-commercial use.

To determine whether your imported device falls under the category of Civil Cryptographic Products and is subject to the regulations of Decree No. 58/2016/ND-CP, we recommend thoroughly reviewing Appendix I issued with this decree.

If the Civil Cryptographic Product Management and Product Inspection Department has confirmed that your goods do not belong to the Civil Cryptographic Product category, you should present this confirmation to the Customs authority responsible for your import procedures for this product.
