Question:
Our company is a foreign-invested enterprise. The business registration certificate of our company is issued with the content: “Manufacturing plastic products: manufacturing plastic bags, plastic cups” (industry code 2220). Based on this content of the business registration certificate, are we allowed to export plastic cup products to foreign partners? Our exported products have two types:
• Unprinted plastic cups
• Plastic cups with custom prints and text
Do we need to obtain any licenses for the export procedures related to the mentioned products?
Answer:
According to the regulations in Decree No. 187/2013/ND-CP dated November 20, 2013, the products inquired by the company do not belong to the list of prohibited exports or restricted exports. The procedures for registration and customs declaration shall be conducted in accordance with Articles 16 and 18 of Circular No. 38/2015/TT-BTC dated March 25, 2015, by the Ministry of Finance. However, if the company’s products contain elements that fall under intellectual property protection, the company must comply with the intellectual property protection laws and regulations in effect.
